Terms of Service

1. Agreement to these terms

These Terms of Service (“Terms”) govern your access to and use of CSTrak, operated by Jacob Saltalamacchia, trading as CSTrak (“CSTrak”, “we”, “us”). By creating an account or using CSTrak, you agree to these Terms on behalf of yourself and, if applicable, the company you represent.

2. The service

CSTrak is a software-as-a-service platform for construction companies to track equipment, manage site-to-site bookings, flag damage, and record warranty information across multiple job sites.

3. Accounts

You must provide accurate information when creating an account. You’re responsible for maintaining the confidentiality of your login credentials and for all activity under your account. One person in your company will typically hold the Admin role and is responsible for managing other users on the account.

4. Subscription plans and billing

4.1 Plans. CSTrak is offered on the following plans, billed monthly or annually in Australian Dollars (AUD). GST is added at checkout; the GST-inclusive amount is what you are charged:

Current pricing and plan features are shown at cstrak.com.au/#pricing and may be updated from time to time; changes will not apply to your current billing period.

4.2 Payment. Payments are processed by Stripe. By subscribing, you authorise us (via Stripe) to charge your nominated payment method on a recurring basis until you cancel.

4.3 Trials and promotions. Where a free trial or promotional discount is offered, its terms (length, eligibility) will be stated at the time it’s offered. We reserve the right to end or modify promotional offers at any time.

4.4 Cancellation. You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period; we do not provide partial-period refunds except where required by Australian Consumer Law.

4.5 Failed payments. If a payment fails, we may suspend access to your account until payment is resolved. We’ll make reasonable efforts to notify you before suspension.

5. Acceptable use

You agree not to:

  • Use CSTrak for any unlawful purpose
  • Attempt to access another company’s data without authorisation
  • Upload malicious code or attempt to interfere with the platform’s operation
  • Reverse-engineer or resell access to CSTrak without our written permission

6. Your data and content

You retain ownership of the equipment records, photos, documents, and other content you upload to CSTrak (“Your Content”). You grant us a licence to host, store, and process Your Content solely for the purpose of providing the service to you. See our Privacy Policy for how we handle personal information.

You’re responsible for ensuring you have the right to upload any content you add to CSTrak, and that it doesn’t infringe anyone else’s rights.

7. Service availability

We aim to keep CSTrak available and reliable, but we don’t guarantee uninterrupted access. We may need to suspend the service for maintenance, and we’re not liable for outages caused by our third-party infrastructure providers (including Supabase, Stripe, or Vercel) beyond our reasonable control.

8. Termination

We may suspend or terminate your account if you breach these Terms, or if your subscription payment fails and isn’t resolved within a reasonable period. You may close your account at any time; see Section 4.4 for the billing effect of doing so.

On termination, we may delete your account data after a reasonable period, subject to any legal retention requirements described in our Privacy Policy.

9. Limitation of liability

To the extent permitted by law, CSTrak is provided “as is.” We are not liable for indirect, incidental, or consequential loss arising from your use of the platform, including loss of data, revenue, or business opportunity. Nothing in these Terms excludes any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

10. Changes to these terms

We may update these Terms from time to time. We’ll update the “Last updated” date and notify account admins of material changes. Continued use of CSTrak after changes take effect means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of its courts.
